Second Appellate Victory in 2022
Shareholders Gerry Fagan and Afton Ball won their second appellate victory before the Montana Supreme Court in four months. The Supreme Court affirmed a 2021 jury verdict in favor of Fagan’s and Ball’s client the City of Sidney in a wrongful discharge case brought by a former police officer for the City. The jury had unanimously ruled in approximately an hour that the City had reasonable grounds to terminate the officer because he had failed to follow officer safety standards. The Supreme Court unanimously affirmed the verdict in the City’s favor. The case is reported at Stinchfield v. City of Sidney, 2022 MT 222N.
